Every week, families across the country face a gut-wrenching situation: a loved one is in the hospital, unable to speak for themselves, and no one knows what they would want. Doctors are asking hard questions. Family members are arguing. Adult children who live in different states are flying in with different ideas about what "Mom would have wanted."

This scenario plays out thousands of times a day in American hospitals — and in the overwhelming majority of cases, it could have been prevented with a few simple legal documents called advance directives.

Most people focus on the financial side of estate planning: who gets the house, who inherits the retirement account, how to avoid probate. Those things matter. But advance directives answer a different — and in many ways more urgent — question: Who makes decisions for you while you're still alive but can't speak for yourself?

This guide breaks down the three essential advance directive documents every adult should have, what each one does, how they work together, and what happens if you don't have them in place.

What Are Advance Directives?

The term "advance directive" is an umbrella term for any legal document that communicates your healthcare wishes in advance — before a medical crisis occurs. These documents allow you to:

Specify the types of medical treatment you do or don't want
Appoint someone you trust to make healthcare decisions on your behalf
Give physicians actionable, immediately-honored medical orders for end-of-life care

Advance directives are separate from a financial power of attorney (which covers bank accounts, real estate, and financial decisions) and a last will and testament (which only takes effect after death). Advance directives are specifically about your medical care during your lifetime.

The three most important advance directive documents are:

The Living Will (also called a healthcare directive or directive to physicians)
The Healthcare Proxy (also called a durable power of attorney for healthcare or healthcare agent designation)
The POLST Form (Physician Orders for Life-Sustaining Treatment)

Each one serves a distinct purpose, and a complete advance planning package typically includes all three.

The Living Will: Your Voice When You Can't Speak

What It Is

A living will is a written document in which you state your wishes regarding medical treatment if you become incapacitated and are unable to communicate. It typically addresses situations involving terminal illness, permanent unconsciousness (like a persistent vegetative state), or end-stage conditions where recovery is not expected.

What It Covers

A well-drafted living will can address a wide range of medical decisions, including:

Life-sustaining treatment: Do you want a ventilator (breathing machine) if you can no longer breathe on your own? Do you want CPR if your heart stops?
Artificial nutrition and hydration: Do you want a feeding tube if you can no longer eat or drink?
Dialysis: If your kidneys fail, do you want dialysis to continue?
Comfort care and pain management: Do you want aggressive pain relief, even if it might hasten death?
Organ and tissue donation: Do you wish to donate your organs?
Hospitalization vs. hospice: If you are terminally ill, do you prefer to remain at home or in a hospice setting rather than a hospital?

What It Doesn't Do

A living will cannot anticipate every possible medical scenario — medicine is simply too complex and unpredictable. It also doesn't appoint anyone to speak for you. That's where the healthcare proxy comes in.

Important Nuance: When Does It Activate?

A living will only applies when you lack the capacity to make your own decisions and when the circumstances described in the document are present (for example, a terminal diagnosis). If you're conscious and competent, you retain full authority over your own medical care regardless of what your living will says.

The Healthcare Proxy: Your Medical Decision-Maker

What It Is

A healthcare proxy (also called a durable power of attorney for healthcare, healthcare agent, or healthcare surrogate, depending on the state) is a legal document in which you appoint a specific person — called your agent or proxy — to make medical decisions on your behalf if you become unable to do so.

This is arguably the most powerful advance directive document, because it appoints a real human being who can respond to real-time medical situations that no written document could fully anticipate.

What Your Agent Can Do

Your healthcare agent can:

Consult with doctors, nurses, and specialists on your behalf
Access your medical records (HIPAA authorization is typically built into the document)
Consent to or refuse medical procedures, surgery, medications, and tests
Make decisions about nursing home placement or transfer between facilities
Hire and fire medical providers
Carry out your wishes as expressed in your living will — or make judgment calls when a situation isn't covered

Choosing the Right Agent

This is one of the most important decisions you'll make in your estate plan. Your healthcare agent doesn't need to be a lawyer, a doctor, or even a family member — but they need to be someone who:

Knows your values and wishes well enough to honor them even under pressure
Can handle stress and make difficult decisions in a crisis
Is available and reachable — geographic proximity matters in emergencies
Will advocate firmly on your behalf, even when other family members disagree
Will follow your wishes, not their own — this distinction is critical

Many people choose a spouse or adult child, which is often appropriate. But sometimes the person who loves you most is not the best person to make hard decisions under pressure. Choose based on capability, not obligation.

The Difference Between a Healthcare Proxy and a Living Will

Think of it this way: your living will is your written instruction manual. Your healthcare proxy is the person who carries out those instructions — and fills in the gaps when the manual doesn't cover a particular situation. Both documents are stronger when they exist together.

The POLST Form: Medical Orders That Travel With You

What It Is

POLST stands for Physician Orders for Life-Sustaining Treatment. Unlike a living will or healthcare proxy — which are legal documents that communicate your preferences — a POLST form is an actual medical order signed by a physician (or in some states, a nurse practitioner or physician assistant).

This distinction is critically important. Emergency medical technicians (EMTs), paramedics, and emergency room staff are legally required to follow a POLST form. They are not required to search for and honor a living will in a crisis situation.

Who Needs a POLST Form

A POLST form is not appropriate for healthy adults or those in middle age — it's specifically designed for:

Individuals with a serious illness or advanced chronic condition
Older adults with frailty or significantly declining health
Anyone with a life expectancy of approximately one year or less
Individuals residing in nursing homes, assisted living facilities, or receiving hospice care

For these individuals, a POLST form provides immediate, actionable clarity in an emergency. If a 78-year-old woman with advanced heart failure goes into cardiac arrest and EMS arrives, they will follow the POLST — they don't have time to locate and read a living will.

What a POLST Form Addresses

While forms vary by state (the form is called MOLST in New York and some other states, MOST in others), they typically address:

CPR: Attempt resuscitation, or do not attempt resuscitation (DNR/DNAR)
Medical interventions: Full treatment (including hospitalization and ICU), limited interventions (comfort-focused with some medical treatment), or comfort measures only
Artificial nutrition: Whether to use a feeding tube and for how long

How It Works in Practice

The POLST form should be kept somewhere easily accessible — on the refrigerator, in a bedside drawer, or in a folder that caregivers know about. In a nursing home or assisted living facility, it lives in the front of the medical chart. When EMS is called, they look for it. When a patient is transferred between facilities, the POLST travels with them.

Critically, a POLST form can be revoked or changed at any time as long as the patient has decision-making capacity. It is not a permanent document — it reflects your wishes at a specific point in your life and should be revisited as your health changes.

How the Three Documents Work Together

Think of advance directives as a layered system:

The Living Will sets the foundation — your values and general wishes about medical care
The Healthcare Proxy appoints a real person to act in real time — filling in gaps the living will can't anticipate
The POLST Form translates your wishes into immediate, enforceable medical orders for serious illness or end-of-life situations

Together, these three documents provide overlapping protection that ensures your wishes are known and honored at every stage — from a relatively routine hospitalization to an end-of-life emergency.

What Happens If You Don't Have These Documents

Without advance directives, several things can go wrong:

Default decision-makers may not be who you'd choose. Every state has a hierarchy of who can make healthcare decisions for an incapacitated patient — typically spouse, then adult children, then parents, then siblings. But what if you're estranged from your spouse? What if your adult children disagree? What if you have a long-term partner you're not married to?

Family conflict can delay or derail care. When family members disagree about a loved one's wishes, the dispute can escalate to court — sometimes in the middle of a medical crisis. These cases are emotionally devastating and financially draining.

Guardianship proceedings may be required. If there's no healthcare agent designated and no family consensus, a court may need to appoint a guardian to make medical decisions. Guardianship is a legal process that takes time and money — neither of which is plentiful in a medical emergency.

Your wishes may simply not be followed. Without a POLST form, emergency responders will default to full resuscitation measures. Without a living will, doctors may not know whether to escalate or withhold treatment. Without a healthcare proxy, the person making decisions may not be the person you would have chosen.

State-Specific Considerations

Advance directive laws vary by state. Some key points to know:

Witnesses and notarization: Some states require two witnesses; others require a notary; some require both. Requirements for who can serve as a witness also vary (for example, many states prohibit healthcare providers from serving as witnesses).
Portability: A document valid in one state is generally honored in other states, but it's not guaranteed. If you spend significant time in multiple states, consider having documents drafted in each.
POLST terminology: The form goes by different names — POLST, MOLST, MOST, POST — depending on the state. Your elder law attorney or physician can help you obtain the correct form.
Agent authority: Some states limit what healthcare agents can authorize (for example, some states require explicit written permission before an agent can consent to withdrawal of artificial nutrition).

When to Create (or Update) Your Advance Directives

The answer to "when should I have these documents?" is simple: now. Every competent adult over 18 should have at minimum a living will and a healthcare proxy in place. Medical crises don't wait until you're elderly — accidents happen, diagnoses arrive unexpectedly, and sudden illness can strike at any age.

You should also revisit your advance directives:

After a major health diagnosis
When your health status changes significantly
If your designated healthcare agent is no longer able or willing to serve
After a significant change in your family situation (divorce, death of a spouse, estrangement)
Every five years as a general review

The POLST form, specifically, should be updated any time there is a significant change in your health status or when your care goals shift.

Starting the Conversation

The hardest part of advance directive planning often isn't the legal paperwork — it's the conversation. Talking about death and incapacity is uncomfortable. Families avoid it. People assume their loved ones "already know" what they'd want.

They usually don't.

Research consistently shows that even spouses who have been married for decades are often unable to accurately predict each other's end-of-life preferences. The only way to ensure your wishes are known is to write them down — and talk about them.

Share copies of your advance directives with your healthcare agent, your primary care physician, any specialists involved in your care, and the facilities where you receive care. Keep a copy somewhere accessible at home.
